Rules for using Llámenos, your responsibilities, and the limits of our liability.

These Terms of Service (“Terms”) govern your use of the Llámenos iOS application (“App”) and any associated services operated by your hub administrator (“Hub Operator”). By using the App, you agree to these Terms.

If you are using Llámenos as part of an organization’s hub, the Hub Operator may have additional terms that govern your use. In the event of a conflict, the Hub Operator’s terms apply within their hub.


1. What Llámenos Is

Llámenos is open-source software for operating crisis response hotlines. The app connects to a self-hosted hub operated by an organization (the Hub Operator). Llámenos (the software project) does not operate any hub and is not a party to any communications made through a hub.

Your relationship is with your Hub Operator, not with the Llámenos project. The Hub Operator is responsible for their server, data practices, telephony configuration, and compliance with applicable laws.


2. Eligibility

You may use the App if you are:

  • At least 18 years old (or the age of majority in your jurisdiction)
  • Authorized by a Hub Operator to join their hub
  • Using the App in compliance with all applicable laws

The App is not intended for use by minors. If you are a minor, do not use this App.


3. Acceptable Use

You agree not to:

  • Use the App to harass, threaten, or harm any person
  • Interfere with or disrupt the App, its servers, or connected networks
  • Attempt to reverse-engineer, bypass, or circumvent any encryption or security mechanisms
  • Impersonate another person or misrepresent your identity or role
  • Use the App in violation of any applicable law or regulation
  • Use the App to transmit malware, spam, or unauthorized automated messages
  • Access or attempt to access accounts or data you are not authorized to view
  • Use the App to operate a hotline without proper authorizations required in your jurisdiction

Crisis line operations may be subject to local, national, or international regulations. You are responsible for compliance with any licensing, training, or certification requirements applicable to your role.


4. Your Responsibilities

Account security: You are responsible for maintaining the confidentiality of your PIN and device credentials. If you believe your account has been compromised, notify your Hub Operator immediately.

Content you create: You are responsible for notes, reports, and other content you create through the App. Content should be accurate, relevant to the call or case, and consistent with your organization’s policies.

Appropriate use: The App is designed for crisis response operations. Use it in accordance with your organization’s protocols and applicable professional standards.


5. Encryption and Data

The App uses end-to-end encryption. If you lose access to your PIN or device and cannot recover it, encrypted data may be permanently inaccessible. This is a deliberate security feature. The Llámenos project and Hub Operators cannot recover encrypted content on your behalf.


6. Service Availability

The App depends on infrastructure operated by your Hub Operator and third-party telephony providers. We do not guarantee uninterrupted availability. The Llámenos project provides the software on an “as is” basis — uptime and reliability depend on how the Hub Operator deploys and maintains their instance.

For crisis-critical operations: Ensure your Hub Operator has appropriate redundancy, monitoring, and fallback procedures in place. Llámenos is a tool — your organization’s operational procedures determine reliability.


7. Intellectual Property

The Llámenos software is open source under the GNU Affero General Public License v3.0 (AGPL-3.0). You may use, modify, and distribute the software in accordance with that license.

The Llámenos name and logo are trademarks of the Llámenos project. You may not use them to imply endorsement of a derivative product without permission.


8. Limitation of Liability

To the maximum extent permitted by applicable law:

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE LLÁMENOS PROJECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR HARM ARISING FROM RELIANCE ON THE APP IN CRISIS SITUATIONS.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or liability for fraudulent misrepresentation.


9. GDPR and Data Processing

The Llámenos project processes minimal personal data in connection with the open-source project itself (e.g., GitHub account data for contributors). For data processed through a hub, the Hub Operator is the data controller and is responsible for GDPR compliance.

10. Governing Law

These Terms are governed by the laws of the European Union and, where applicable, the laws of the member state in which the Llámenos organization is established. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction, unless applicable consumer protection law requires otherwise.


11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
